• Securities Arbitrators Are Selected By The Parties: FINRA provides both sides with a list of potential securities arbitrators to hear and decide your securities arbitration case.  Most often, the securities arbitrators are selected on a random basis.
• Initital Prehearing Conference: This takes place typically 90 to 120 days after your securities arbitration claim is filed. Procedural matters are addressed in this pre-hearing conference.
• Discovery:  This is when your stock broker or stock brokerage firm must turn over copies of records relating to your accounts and internal documents relating to operations of the firm.  You must also produce copies of tax returns and other documents relating to  your securities claims.
• Settlement Discussions: Settlement negotiations can occur at any time in the securities arbitration process, but this is the time settlement demands are typically made and settlement negotiations  begin.  This settlement stage is typically 8 to 12 weeks prior to the securities arbitration hearing.  While most cases settle at this time, there is no guarantee that any case will settle at this time, or at any other time.
• Arbitration Hearing: If your claim is not settled, your securities arbitration case may then go to hearing.  A securities arbitration hearing typically lasts for 2 to 3 days in a private confidential setting in a location near you.  After the hearing, the securities arbitrator or securities arbitration panel, will make a binding decision on your claim(s) and issue a securities arbitration award.

The next step in the securities arbitration process typically involves an initial pre-hearing conference.  The prehearing conference is usually set soon after the arbitrators are appointed.  The parties and the arbitrators participate in the conference.   At the conference, the arbitrators decide various procedural matters, such as discovery between the parties, and set a securities arbitration hearing date(s). Respondent Broker or Brokerage Firm Answers The Statement of Claim.

After being served with a Statement of Claim, a Respondent (or Defendant) broker or brokerage firm typically will file an Answer or Response admitting or denying the allegations in the Statement of Claim, and setting forth additional or different statement of the facts, and legal arguments, as to why the investor’s claims are legally or factually insufficient, why the investor’s claims ought to be denied, and/or why the investor is not entitled to relief of any kind.  

Motions To Dismiss Are Disfavored

Although a broker or brokerage firm can file a motion to dismiss a Statement of Claim, such motions to dismiss are generally disfavored in arbitrations.  Under a recent FINRA rule, for example, a dispositive motion can be granted before a claimant finishes presenting its case only if the parties have settled their dispute in writing; there is a “factual impossibility,” meaning the defendant could not have been associated with the conduct at issue; or, the motion could be granted under the  rule that requires parties to bring arbitration claims within six years of the events at issue.  Any decision to grant a dispositive motion before a claimant presents his case must be unanimous.  

Respondent Broker or Brokerage Firm Must Pay Its Member Fee

Typically the respondent broker or brokerage firm named as a party to the arbitration will also be required to pay a member surcharge fee.
